The Brazil betting ban hearing is set for Tuesday, Nov. 3, and the ban stays in force in the meantime. In an order on Monday, Oct. 26, Supreme Court Justice Luiz Fux did not suspend Provisional Measure 1,394 and called 26 participants to the hearing instead, including 10 football clubs, according to BNLData. Any ruling on the operators’ requests will now come after that hearing.

  • The cases: the order was issued in the case brought by the betting groups ANJL and IBJR, and copies were attached to six related challenges.
  • The background: the measure, signed Sept. 25, banned fixed-odds betting, and every operator license expired on Oct. 25.

What did the Supreme Court decide on the Brazil betting ban?

The Supreme Court left the Brazil betting ban in place for now. Justice Fux, who handles all the challenges to Provisional Measure 1,394, issued his order on the night of Oct. 26 in the case filed by the National Games and Lotteries Association (ANJL) and the Brazilian Responsible Gaming Institute (IBJR), BNLData reported.

He did not rule on the merits. Instead, he called a public hearing, a format the court uses to hear experts and affected groups before a decision. The hearing was requested by the Attorney General’s Office (AGU), by the ANJL and IBJR, and by other parties that joined the case, according to BNLData. Copies of the order were also attached to six other challenges, filed by groups such as the National Confederation of Commerce, the Prosecutor General’s Office and an association of mayors.

The timing was expected. Fux chose to wait until after the presidential runoff on Oct. 25 to avoid any claim that the court was interfering in the election, according to Folha de S.Paulo, as reported by Brasil 247. Lula won that runoff, as we covered in what his re-election means for the betting ban.

Who will speak at the Brazil betting ban hearing?

BNLData lists 26 participants in four groups. Here is how they break down:

Group

Participants

Groups that filed the cases (7)

CNC, Prosecutor General's Office, ANSEJA, ANJL, IBJR, ANPV (mayors) and Abracopel (state lotteries)

Federal government (2)

Attorney General's Office and Finance Ministry

Business groups and academia (6)

ABERT (broadcasters), ABRACRIM, UERJ's economic regulation lab, CNI (industry), ABLE and AIGAMING

Football (11)

Flamengo, Fluminense, Botafogo, Cruzeiro, São Paulo, Corinthians, Ponte Preta, Vitória, Guarani, Portuguesa and the CBF

The Health and Justice ministries are not on the list, and no individual betting operator was invited, BNLData reported. The licensed industry will be heard through its associations.

The clubs matter because betting brands sponsor much of Brazilian football. In their filings, the ANJL and IBJR argue that suspending the licenses undercuts investments made under the earlier rules and hits contracts with clubs, broadcasters and other partners. The government defends the ban by pointing to gambling addiction and rising family debt, Brasil 247 reported.

How does this compare with past cases, and what comes next?

This is not the first time Fux has called a hearing on betting. On Nov. 11 and 12, 2024, he held a two-day public hearing on the 2023 law that created the licensed market, and on Nov. 13, 2024, he ordered immediate limits on betting ads aimed at children and barred the use of welfare funds for betting, according to the law firm Demarest. He did not suspend the law then. The licensed market opened on Jan. 1, 2025, and lasted less than two years.

The lower courts have not helped the operators either. Companies and the ANJL filed 19 cases in federal courts against the measure, and none won an injunction, BNLData reported. Before the runoff, Regulus Partners put the chance that Fux would strike down or suspend the ban at only 5%, NEXT.io reported.

Congress is the other clock. On Nov. 9, the measure moves to the top of Congress’ agenda, and lawmakers face a first deadline to vote on Nov. 23, with a possible 60-day extension, according to NEXT.io. What it means for players outside Brazil

For players in the US, Canada, the UK, Australia and Ireland, nothing changes: the ban covers betting in Brazil only. For international operators, the hearing is the next date to watch, and the case is a reminder that a licensed market can close in weeks.
