Quick summary

  • The order: Justice Fux expanded the guest list on Sunday, Nov. 1, after a request from the AGU, Agência Brasil and Poder360 reported.

  • The count: 34 bodies, agencies and associations will now speak, according to Agência Brasil.
  • The date: Tuesday, Nov. 3, at 10 a.m. Brasília time (8 a.m. ET), streamed on the court’s YouTube channel.
  • The ban: Provisional Measure 1,394 stays in force while the court hears the case.

Who was added to the Brazil bets hearing?

Six new names joined the Brazil bets hearing on Nov. 1. The two ministries were the core of the AGU’s request. Fux also called Abras, the Brazilian Paralympic Committee, the National Federation of Professional Football Players (Fenapaf) and Grêmio, a Porto Alegre club, Agência Brasil reported. CNN Brasil and Migalhas also reported the addition of the two ministries.

This is the second expansion. When Fux called the hearing on Oct. 26, the list had 26 participants, as we covered in our report on the original order. On Oct. 27, he added the Sports Ministry and the Brazilian Olympic Committee, according to Poder360. With six more on Nov. 1, the total reaches 34.

Abras is a notable addition. The supermarket group reported a 6.5% rise in supermarket sales in the week of Oct. 5-11, as we covered in Brazil betting ban: supermarket sales.

Why did the government ask for more speakers?

The AGU said the original list was “predominantly” made up of sports bodies and betting operators’ representatives, according to Agência Brasil. In its filing, it argued that this mix could make it harder to hear a balanced range of opinions, data and expertise.

The football side was large. The first list included 10 clubs and the Brazilian Football Confederation (CBF), many of them sponsored by betting brands. The industry is heard through its associations, such as the ANJL, which filed the main case against the ban.

Fux did not add every group that has spoken against betting before. In his order, he noted that he ran two public hearings in November 2024, where groups such as the Brazilian Psychiatric Association and the consumer group Idec described what he called the “harmful social consequences” of betting. He wrote that those harms are already known to the court, Agência Brasil reported. None of those groups is on Tuesday’s list.

How does this compare with past cases, and what comes next?

The 2024 hearings, held Nov. 11 and 12, dealt with the 2023 law that created Brazil’s licensed betting market. Fux did not suspend that law. The licensed market opened on Jan. 1, 2025. Provisional Measure 1,394, signed on Sept. 25, 2026, banned fixed-odds betting, and every operator license expired on Oct. 25.

This time, the roles are reversed. In 2024, the industry defended a law already in force. Now it is asking the court to suspend a ban. Fux has so far refused to grant any injunction, and the ban stays in place.

Here is the timeline so far:

Date

Step

Sept. 25

Provisional Measure 1,394 bans fixed-odds betting

Oct. 25

All operator licenses expire

Oct. 26

Fux keeps the ban and calls a hearing with 26 participants

Oct. 27

Sports Ministry and Olympic Committee added

Nov. 1

Health and Justice ministries, Abras and 3 sports bodies added (34 in total)

Nov. 3

Public hearing at 10 a.m. Brasília time

The hearing itself is not a ruling. After it, Fux can decide on the operators’ requests for an injunction, and the full court can later rule on the case. Agência Brasil published the schedule with a time slot for each speaker. For the political background, see what Lula’s re-election means for the betting ban.

What it means for players outside Brazil

The ban applies only to betting in Brazil, so players in the US, Canada, the UK, Australia and Ireland are not affected directly. For the industry, the case is a live test of how fast a licensed market can close, and of who gets a voice when it does.
